Terms of Service
These Terms of Service ("Terms") govern your access to and use of VinVibe ("we", "us", or "our"), available at vinvibe.app. By creating an account or using the service, you agree to these Terms. Please read them carefully.
Acceptance of Terms
By accessing or using VinVibe — whether by creating an account, browsing public pages, or using any feature of the service — you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use VinVibe.
These Terms form a binding legal agreement between you and VinVibe. We may also have additional guidelines or policies that apply to specific features of the service; those are incorporated into these Terms by reference when applicable.
Eligibility
You must be at least 13 years of age to use VinVibe. By creating an account, you represent and warrant that you are 13 years of age or older. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian to use the service.
If we discover that an account belongs to someone under 13, we will terminate that account and delete its data without notice, as described in our Privacy Policy.
Account Registration
To access most features of VinVibe, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.
You are responsible for maintaining the confidentiality of your account credentials (username and password). You agree to notify us immediately at vinvibeapp@gmail.com if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account, whether or not you authorized it. VinVibe is not liable for any loss or damage arising from unauthorized use of your account.
User Content
You own your content. Any content you create on VinVibe — including your vinyl collection records, wantlist entries, personal notes, written stories, profile biography, and uploaded photos — remains your property. VinVibe does not claim ownership over your content.
License to VinVibe. By posting or uploading content to VinVibe, you grant us a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and distribute that content within the VinVibe platform and in related promotional materials (for example, featuring a public collection in a discovery feed or a blog post about the platform). This license exists only to operate and improve the service and does not allow us to sell your content to third parties.
Your representations. By posting content, you represent that you have all necessary rights to that content and that it does not infringe the intellectual property, privacy, or other rights of any third party.
You can delete your content at any time through your account settings. When you delete your account, your content will be removed as described in our Privacy Policy.
Acceptable Use
You agree to use VinVibe only for lawful purposes and in a manner consistent with these Terms. The following are expressly prohibited:
- Harassment and abuse: Sending threatening, hateful, or harassing messages to other users, or engaging in conduct designed to intimidate, demean, or harm others.
- Impersonation: Pretending to be another person, a VinVibe employee, or a public figure in a way that could mislead or deceive others.
- Spam: Posting repetitive, unsolicited, or off-topic content, or using the platform to distribute commercial advertisements without our prior consent.
- Copyright infringement: Uploading, posting, or sharing content that infringes the intellectual property rights of any person or entity, including music recordings, album artwork, or photographs you do not have the right to share.
- Illegal content: Posting content that is illegal under applicable law, including content that depicts or promotes violence, exploitation of minors, or unlawful discrimination.
- Automated scraping: Using bots, crawlers, scrapers, or any automated means to access, collect, or copy data from VinVibe without our express written permission.
- Security circumvention: Attempting to probe, scan, or test the vulnerability of our systems, or bypass any authentication or security measures, or disrupt the service.
- Rate limit abuse: Sending an abnormally large number of requests to our API or edge functions in a way that burdens our infrastructure.
We reserve the right to remove any content or suspend any account that we determine, in our sole discretion, violates these guidelines.
Third-Party Integrations
VinVibe integrates with third-party services including Discogs, Spotify, Apple Music / iTunes, MusicBrainz, and Google. Your use of these integrations is subject to each service's own terms of service and privacy policy. VinVibe is not affiliated with, endorsed by, or sponsored by any of these companies.
When you connect your Discogs account to VinVibe, you authorize us to access your Discogs collection data on your behalf using the Discogs API. You may disconnect this integration at any time from your profile settings. Disconnecting does not automatically delete the data already imported — you must delete those records manually or request account deletion.
Third-party services may change or discontinue their APIs at any time. We cannot guarantee that integrations with these services will always be available or fully functional, and we are not responsible for any interruptions caused by changes to third-party services.
Public Profiles and Discoverability
By default, your VinVibe profile, vinyl collection, and public posts are visible to anyone on the internet, including search engines. This is intentional — VinVibe is designed to help music lovers discover each other's collections and stories.
If you prefer a private experience, you can enable private account mode in your profile settings. When enabled, your collection and posts will only be visible to users you have approved. Taste Twins matching and global discovery features will also be limited while your account is private.
Your email address is never publicly visible regardless of your privacy setting.
Intellectual Property
The VinVibe name, logo, design, platform interface, original code, and all original written and visual content created by VinVibe are the exclusive intellectual property of VinVibe and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from VinVibe's proprietary content without our prior written permission.
Record metadata (artist names, album titles, release years, genres) sourced from Discogs and MusicBrainz is subject to their respective licenses. Album artwork displayed on VinVibe is sourced from these databases or uploaded by users; we do not claim ownership of artwork sourced from third parties.
Privacy
Your privacy matters to us. How we collect, use, and protect your personal information is described in our Privacy Policy, which is incorporated into these Terms. By using VinVibe, you also agree to our Privacy Policy.
Disclaimer of Warranties
VinVibe is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the service will be available at all times, error-free, or uninterrupted. We may need to take the service offline for maintenance, updates, or due to circumstances outside our control.
Record metadata, cover art, and audio previews are sourced from third-party databases (Discogs, MusicBrainz, iTunes). We do not guarantee the accuracy, completeness, or timeliness of this information. Some records may be missing metadata or artwork, and some audio previews may become unavailable if the third-party source removes them.
Limitation of Liability
To the maximum extent permitted by applicable law, VinVibe and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to loss of data, loss of revenue, or loss of goodwill.
In no event shall VinVibe's total liability to you for all claims arising from these Terms or your use of the service exceed the greater of (a) the total amount you have paid VinVibe in the twelve months preceding the claim, or (b) CAD $50.00. Because VinVibe is currently a free service, this effectively means our liability is capped at CAD $50.00.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages; if you are in such a jurisdiction, the above limitations apply only to the fullest extent permitted by law.
Termination
By you: You may delete your account at any time through your profile settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.
By VinVibe: We reserve the right to suspend or permanently terminate your account, without notice, if we determine in our sole discretion that you have violated these Terms, engaged in conduct harmful to other users, or acted in a way that threatens the integrity or security of the platform. We will not be liable to you for any such termination.
Upon termination, your license to use VinVibe ends immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) will continue to apply.
Changes to These Terms
We may update these Terms from time to time to reflect changes in the law, our services, or our practices. When we make material changes, we will notify you by email or by displaying a notice within the app at least 30 days before the new Terms take effect. Your continued use of VinVibe after the effective date of the updated Terms constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the service before they take effect.
Governing Law
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any legal proceeding arising from or relating to these Terms or your use of VinVibe shall be brought exclusively in the courts located in the Province of Ontario, Canada. By using VinVibe, you consent to the personal jurisdiction of those courts.
